Who Pays When a Delivery Driver Hits a Pedestrian While on the Job?

Staff WriterThe Herald-Dispatch

Most of the time, the driver's employer pays through its commercial auto insurance, as long as the driver was working when the crash happened. If the driver counts as an independent contractor, the bill may be split between the driver's own policy, the delivery app, and anyone else who played a part.

San Bernardino County is larger than nine states and is a major logistics hub in Southern California, with an extensive network of warehouses, distribution centers, and highways. Delivery vans and box trucks regularly travel through its commercial and residential areas, sharing roads with pedestrians throughout the day.

Anyone struck in San Bernardino by a driver on a delivery route may find the insurance side confusing, and San Bernardino pedestrian accident support can help sort out whose policy to look at first.

Brief Overview

The employer is usually the first party responsible when a delivery driver hits a pedestrian during a work trip.Independent contractor status makes the case harder, although courts look at how much control the company actually had.A driver's personal insurance often excludes delivery work, so the commercial policy tends to matter most.A pedestrian who shares some blame can still recover, though the amount may be reduced.

Who Is Responsible When a Delivery Driver Hits a Pedestrian at Work?

These are the likely parties to be held responsible when a delivery driver hits a pedestrian while on the job:

The Employer, When the Driver Was on the Clock

California Civil Code section 2338 makes a business responsible for the negligence of someone acting for it while carrying out its work, so a pedestrian hit during a delivery route can usually go after the company as well as the driver.

That changes when the driver was running a personal errand or commuting, since employers are generally not liable for those trips. A company can also face its own claim for keeping a driver with a bad record on the road.

The Delivery App, When the Driver Is a Contractor

Many app and courier drivers are classified as independent contractors, and the company often says it owes nothing for that reason.

Courts tend to look past the label and ask how much control the company had over the work, such as routes, schedules, and deadlines, which makes this the most contested question in many cases.

The Driver's Insurer and the Vehicle Owner

A personal auto policy often excludes delivery work, so the commercial policy usually matters more. If the van belongs to a rental company or a fleet owner, that owner's coverage may come into play as well.

These are the parties worth checking early.

What If the Pedestrian Was Partly at Fault?

California Vehicle Code section 21950 requires drivers to yield to pedestrians in marked crosswalks and in unmarked crosswalks at intersections while still reminding pedestrians to use due care for their own safety.

Someone who crosses mid-block gives up much of that right of way, and a jury may assign them a share of the blame that reduces what they recover. The driver still owes due care, so partial fault usually shrinks a claim instead of ending it.

What Evidence Helps Show Who Is Responsible?

Delivery companies keep more records than most defendants, including trip logs, GPS pings, and sometimes in-cab camera footage, and some of it can be overwritten on a routine schedule.

Photos of the scene and of any company markings on the vehicle help too, along with an early written request that the company preserves its data.

Most California injury lawsuits must be filed within two years underCode of Civil Procedure section 335.1, although claims against a government entity carry a much shorter notice window.
